Terms And Conditions

Please have in mind I am not a professional and did not go to an art school or college, everything was self taught.

  • Payment before commission, no exceptions.

Payment should be made after I’ve seen the provided reference sheet. I will not work on the commission if some form of payment isn’t made. If you were to fall under the situation where it is estimated that you won’t be able to meet the payment date, cancel the commission. Do not wait to cancel commissions if you have insufficient funds. (It is preferably that all this is sorted out before I start) Please have in mind after payment is sent, refund is not available. Do not commission me if you end up in a situation where you must have your money returned. Once I have received payment, you will receive the requested commission with my best efforts. If you happen to request your commission through payments I will still accept your commission. Please have in mind what was previously noted on your financial stance during the commission. I will not release the final version of your commission until payments are fully completed. Refer to the third term if you plan to try to prolong the time by making me modify the overall commission. I do not mind waiting an extended amount of time for all the payments but, have in mind you'll be the one waiting for the commission for that extended amount of time.

  • Request a deadline if needed.

Like any person, I have things to tend to and things to resolve. A commission can take a month to finish depending on my current circumstances (school, work, family) and other commissions previous to yours. A month is only a certain safety net of a time range, it does not mean I will take the whole month to finish. If your commissioning me for a piece that needs to be completed under a certain amount of time, you may request a deadline. I need to be given at least a week from the deadline. The likelihood of being able to complete your commission the day it's requested is very low but, not improbable, again depending on the type and detail of the commission. If you choose not to request a deadline, I will take my time and expect not to be constantly contacted for updates. I will update you when I have progressed with the completion of your commission. I appreciate patience. 

  • Reference and Description should be clear and precise.

Reference sheets, images, and descriptions that are unclear and convoluted will be rejected on the spot. Reference provided should clearly show all aspects of the character and their specific details or nature. Their description should be short and direct if it’s not a commission based on their personality. Do not write a story about their past, present and future! These information will only lead to confuse me, I wish not to have an overload of information, Just be simple and direct. If you want a certain detail OF their story to be included just state it. I emphasis on communication here. The better you communicate, the better I deliver.

  • You must own the design being commissioned or have permission.

All materials provided MUST be copyrighted or owned by the provider / commissioner. If you do not own the character you MUST  at very least have permission from the owner to have them drawn. You must show me proof that any third party artist or creator that are involved are okay with their character(s) being drawn by me otherwise I will cancel the commission. If your character is a purchased design you must show me their original design(art) and the name of the creator. (Reasons why I request this information is for the reason people often steal designs and commission pieces of them despite it belonging to someone else and it simply causes problems. I will contact the creator of the design if your ownership of said design seems fraudulent; if they confirm that you in fact do not own the design I will cancel the commission without hesitation.)

  • No refunds, unless I’m unable to complete commission.

I will not refund if the finished commission did not meet your criteria. Plenty of examples of my work were provided on the website. I try my best to accommodate the given design to  fit my art style. If I feel that the commission does not match my experience as an artist I will cancel commission and refund. I can also cancel commission if I know I will be unable to complete it before the set deadline. I would like to emphasize that after the deadline, any received feedback will not be applied as once the deadline reaches. The commission will be automatically considered FINALIZED.

  • I will charge for major changes

As stated before, you must be clear with your description. If I misinterpret something within the reference sheet or your description, I WILL charge extra for these changes to be made. Changes to color and shading are not major changes. An example of a major change is changing the outfit of the character when it wasn’t provided or wasn’t clearly stated. If I missed a detail within your description and reference sheet then the error will fall upon me and so I will gladly fix said error. Otherwise it only depends on how you deliver your information and communicate with me to avoid these mishaps to happen. Do your part properly, and I promise my part flawlessly.

  • I will edit your palette and minor characteristics to my liking

If your character has a color palette that is difficult to handle I will make minor changes to. I won't change the palette entirely but I will make colors lighter or darker depending on the palette. If the colors are too atrocious it is very likely I will reject your commission or cancel and refund it if I'm unable to to complete it. Also, if you hand me a very stylized reference sheet please state what is part of the character and what is not. I will assume either that a certain characteristic of the character is simply stylized and draw it in my own style or vise versa. (i.e character having white dots for pupils rather than black, character having an exaggerated anatomy when it's supposed to be just a normal one or character has stylized eyes when they should be normal eyes.)  Don't leave it up to me if you want something drawn in a specific way. I will draw based on my own taste. Don't make me needlessly edit your commission because you failed to reciprocate your desired features on the commission. 

  • I have the right to cancel the commission at any point in time

My work is not for commercial use, if your commissioning me, it's going to be just a casual commission. If I feel uncomfortable completing the commission or any problems were to rise for any reason I will inform you and refund immediately. Please don't pursue a reason why I'm cancelling the commission for it could be personal or professional cause. If I do give you a reason, don't harass me any further. There can be a possibility I can reconsider your commission in the future. 

  • When payment is made you must state the following within the Paypal payment message!:

I, (your name or username from site you've contacted), am commissioning the artist Xavier Xene. And have agreed to their terms and conditions, I fully accept that this is an authorized payment and acknowledge that I am the owner of this Paypal account. I have spoken to the artist directly and therefore will not charge back the artist after the commission is completed.

If you request an invoice, I will put this statement for you and I will include the link to these terms as well.
